We reserve the right to terminate access for users who violate these prohibitions.

5. Intellectual Property

You retain all ownership rights to files you upload to the Service. By uploading files, you grant us a limited, temporary license to process, store, and manipulate your files solely for the purpose of providing the requested service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRSTCLICKTOOLS AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, files, profits, revenue, or business opportunities
  • Service interruptions, downtime, or technical failures
  • Errors in file processing or conversion
  • Damages resulting from use or inability to use the Service

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO USE THE SERVICE (WHICHEVER IS GREATER).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.

8. Copyright and DMCA Policy

We respect intellectual property rights. If you believe that content processed through our Service infringes your copyright, please contact us with:

Use AI tools at your own discretion and risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless FirstClickTools, its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use or misuse of the Service, your violation of these Terms, your violation of any third-party rights, or content you upload or process through the Service.

We may impose limits on file sizes, number of files processed per session, total usage per user or IP address, and processing time. These limits are subject to change and are designed to ensure fair access for all users.

12. Service Availability

We strive to maintain reliable service but do not guarantee 24/7 uptime, specific processing speeds, compatibility with all file types, or absence of bugs or errors. We may suspend or terminate the Service at any time for maintenance, updates, or other reasons.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, remove or delete any files or content that violate these Terms, and investigate and take legal action against violations. You may stop using the Service at any time.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the appropriate courts.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FirstClickTools regarding the Service.
